For the present instrument, the parts nominated and qualified in the Adhesion Contract to the CONTRACT OF LEASING OF PROPERTY FOR SEASON -TRIP HOMES ("Adhesion Contract", integral part and inseparable of this Contract), respectively, SERVICE PROVIDER COMPANY and CONTRACTOR, have among themselves the fair and agreed the present Contract, that will be ruled by the conditions of the Adhesion Contract and by the following clauses and dispositions.

CLAUSES AND GENERAL CONDITIONS OF THE CONTRACT OF RENT OF PROPERTY BY SEASON -TRIP HOMES


1. SUBJECT MATTER OF THE CONTRACT - PROPERTY AVAILABLE FOR RENTAL 1.1.

1.1 This contract has the purpose of regulating the rights and obligations of the contracting parties, regarding the rental in seasonal renting modality of the property located at (ADDRESS).


2. THE FURNITURE AND UTENSILS

The Leasing Law requires, in the case of temporary leasing of a furnished property, a description of the furniture and fixtures in the property, as well as their condition (Law 8.245/91, Article 48, sole paragraph), which is why the following parts of the property are described below

3. THE PURPOSE OF THE PROPERTY'S USE

3.1. The property subject of this instrument is leased exclusively for the LESSEE'S RESIDENTIAL purpose, being prohibited its use for any other purpose, including subleasing, and that the residents will be composed of the lessor, his family and friends.

3.2 The LESSEE obliges itself and other dependents and guests to respect the rights of the neighborhood with strict observance of the rules provided in Articles 1277 to 1313 of the Civil Code, the Convention, the Internal Regulations or other regulations that may exist to which the property subject of this contract is governed, being responsible for the fines that may be applied because of noncompliance or violations committed.


4. THE RESPONSIBILITIES OF THE LESSOR

4.1. The LESSOR is obliged to deliver the property in good conditions of hygiene and cleanliness, with furniture and fixtures in good state of repair and operation.

4.2. The LESSOR will perform the processes of Check-In, Check-Out and Inspection of the Property.

4.3. The repairs in general relating to the enjoyment of the property arising from normal use will be provided and resolved by the LESSOR in contact with the owner, before and after each vacancy.

4.4 The LESSOR is responsible for the maintenance and proper functioning of the hydraulic and electrical leased property.


5. THE TENANT'S RESPONSIBILITIES

5.1. The LESSOR is obliged to act in accordance with the established in the legal norms before the neighbors and the property, being responsible civil and criminally, during the validity of this instrument.

5.2 The LESSEE is obliged to take care of the conservation, cleaning of the property, safety, appreciating the necessary care for their maintenance, and should notify the LESSOR about any damage.

5.3 The LESSEE is obliged to return the property in the same conditions of conservation of when delivered (according to the term of inspection attached).

5.4 The LESSEE is responsible for any damage that may cause the property, or the goods that decorate it and must return them in the same conditions in which it received.

5.4.1 In having any damage the LESSEE must repair it, at its expense, while the lease lasts.

5.5. The LESSEE is responsible for any damage caused to the property or the furniture that decorates it, except those caused by the natural wear and tear of time.

5.6. The termination of this contract and immediate expropriation of the property will occur, regardless of any prior notice or compensation from the LESSOR or the LESSEE, when: occurring any accident, fire, theft or any crime / crime that will disturb or prevent its possession of the property, regardless of guilt or intent of the LESSEE, and any other hypotheses that tarnish the property of vice and impossibility of its possession.

5.7. The LESSEE will be responsible for any theft occurring within the property, whether caused by him or by third parties.

5.8. The LESSEE declares to receive the property in a state of conservation and functioning exactly as described in the term of inspection of the property attached to this contract.


6. THE VALUE OF THE RENT AND THE CLEANING TAX

6.1 The total value of the daily lease will be R$ X (AMOUNT PER DAY), to be paid as follows:

6.1.1. 50% (fifty percent) will be paid in advance in cash, as a guarantee sign of the lease, in the signing of the contract, in the amount of R$ X (AMOUNT PER EXTENT).

6.1.2. The other 50% (fifty percent), referring to the second part of the payment, may be made until the Check-In, on day X.

6.1.3 Such amounts must be paid through one of the following options:

(a) Cash;
b) Bank Transfer - Nubank Institution (260), Favored: Victor Ferreira Barcelos - CNPJ: 39.837.549/0001-70, Agency: 0001, Account: 37865980-6;
c) PIX Transfer - CNPJ: 39.837.549/0001-70.

6.2 A single cleaning fee will be charged in the amount of $ X (AMOUNT PER ENTRANCE), due at the time of entry of the property, paid along with the value of the lease.

6.3 The LESSEE is also responsible for the payment of the consumption of electricity during the period of leasing, to be charged in the amount of R$ 1.20 (one real and twenty cents) by kWh, with measurement taken in the term of inspection of check-in and check-out of the property.

6.4 The LESSEE is also responsible for the payment of water consumption during the period of leasing, to be charged in the amount of R$11.00 (eleven reais) by m3, with measurement taken in the term of inspection of check-in and check-out of the property.

6.5 In the process of Check-Out, the LESSEE should wait for the representative of the LESSOR COMPANY for the completion of the final inspection of delivery of the property (attached), with the completion of this process through the signing of the inspection by both parties and the delivery of all the keys of the property by the lessee.


7. GIVING UP THE LEASE

7.1 In case of cancellation of the lease by the LESSEE, communicated up to 30 days prior to the date of leasing, the tenant will lose 30% of the total value.

7.2 In the situation of withdrawal of the lease by the LESSEE communicated between 29 and 20 days before the date of leasing, the tenant will lose 50% of the total rental value. In the period less than 19 days of the lease, the loss of value will be full.

7.3 In case of withdrawal of the lease by the LESSOR, without good reason, will be due to the LESSEE the penalty of a fine of 20% of the value of the deposit.


8. THE CONTRACTUAL TERM

8.1. The lease will begin on day X (WEEKLY DAY) from 15:00 pm, and end on day X (WEEKLY DAY) until 11:00 am, when it will cease the effects of this contract, regardless of judicial or extrajudicial notification.

8.2 Staying in the property after the contracted period will imply the payment of the daily rate in double, calculated per proportional hour that exceeds until the definitive eviction, as well as eviction of possession, with the responsibility of a daily fine of R$ 800.00 (eight hundred reais) and losses and damages due to eventual delay in delivering the property to the next tenant.


9. CONFIDENTIALITY AND NON-COMPETITION

9.1 The LESSEE should keep confidential, during the term of this contract and even after its termination, any confidential information concerning the business, policies, trade secrets, organization, creation and other information on the activity and business model of the LESSOR COMPANY.



9.2 For the purposes of this contract, confidential information is defined as: (a) any information related to the business and operations of the activity that is not public, (b) information contained in research, drawings, designs, proposals, projects, business plans, sales or marketing, financial information, costs, pricing data, business partners, suppliers and customers information, industrial secrets, intellectual property, specifications, expertise, techniques, inventions and all methods, concepts or ideas related to the business.

9.3 The contracting party is prohibited from passing on to third parties, whether individuals or legal entities, any of this information, as well as important information related to this contract, except when expressly authorized by the contracting party.

9.4 It is emphasized that the duty of confidentiality remains even after the termination of this contract.

9.5 In case of doubt about the confidentiality of any information, the contractor shall keep it in strict confidence until the contracting party expressly manifests itself about it.

9.6 In the same way, non-competition is naturally derived and based on the principles of commercial loyalty and good faith. Considering the access to information, documents, technical, administrative and commercial confidential knowledge of the LESSOR COMPANY (except those of public knowledge), the LESSEE undertakes not to explore, use or compete, without authorization, with projects and activities undertaken by the LESSOR COMPANY.


10. GENERAL PROVISIONS

10.1 In the event of withdrawal by the LESSEE or the anticipation of the departure of the same, there will be no refund of amounts previously paid or the remaining days.

10.2 In case of termination by the LESSEE for any reason contrary to the stipulated in the contract, will not be refunded any amount paid to the lessor.

10.3 The maximum number allowed for overnight stay in the property will be up to X (VALUE PER EXTENT) people (including children and adults), may invite to use the external area of the house (garden, pool and other facilities) of up to X (VALUE PER EXTENT) people.

10.4 If the number of people indicated above is exceeded without the prior express authorization of the LESSOR, the LESSOR will pay as a daily fine the value of ¼ (one quarter) of the rental unit of the property for each extra person, in addition to compensation for any damage caused to the property by excess guests.

10.5 The LESSOR or someone of his trust will receive the LESSEE at the moment of his arrival, presenting him the property and its main furniture, utensils and decorative objects, when the INITIAL TERM OF VISIT will be signed. At the time of departure should confer together the same goods.

10.6 The LESSEE hereby authorizes the lessor or whoever it indicates to inspect the leased property, when it deems convenient, as well as authorizes access to the property for any necessary repairs, since previously agreed between the parties the time for that.

10.7 The LESSEE exempts the lessor of any responsibility for accidents to people who are staying or using the leased property both inside and outside areas.

10.8 The LESSEE is obliged to return the property to the lessor at the end of the term stipulated in this contract, in the same conditions in which it received, as contained in the inspection form.

10.9 The LESSOR is not responsible for objects left in the property, as well as for theft or robbery of the tenant's property and other damage caused by unforeseeable circumstances or force majeure that cause losses.

10.10. The LESSOR is not responsible for external or regional events that may occur in the property during the lease, such as lack of water or electricity, since the responsibility is the utility company.

10.11. Any and all adjustments between the parties, to integrate this contract, should be made in writing (contractual amendment).


11. GENERAL CONTRACTUAL FINE

11.1 In case of non-observance of any rule of this contract in which no specific fine is stipulated, a fine in the amount of 10% of the total value of the contract is stipulated, for any infraction to what is determined herein.

11.1.1 The collection of this fine does not rule out those relative to others eventually imposed in this contract.


12. EXTRAJUDICIAL EXECUTION TITLE

This contract has an enforceable nature, with the recognition of the terms of the covenant entered into by the parties raising the contract to an extrajudicial execution title (Article 784, III, of the New Code of Civil Procedure), allowing its execution without the need for a prior knowledge process, which will demand significant time and risk of not reaching the compliance of sentence.


13. OF THE JUDICIAL LITIGATION



13.1 The competent action will be opposed to indemnification for losses and damages, property damage and / or moral damages for any harmful acts caused by the LESSEE to the property or the reputation and image of the LESSOR.

13.2 In return for the labor efforts previously mentioned, the lawyer hired will receive from the tenant as attorney's fees the amount of 30% (thirty percent) on the total income of the value of the action.


14. THE FORUM

It is elected the district court of Aracaju / SE to settle any doubt arising from this instrument, reserving to the LESSOR COMPANY, however, the right to choose the forum of domicile of the LESSEE.
